Remote Handover of a New Apartment in Israel
A new Israeli apartment can sometimes be handed over through representatives when the contract, applicable law, developer process and accepted authority documents allow it. A power of attorney is not, by itself, a remote-handover system. A controlled process separates the lawyer, engineer, local representative and property manager, obtains site approval in advance, reconciles the signed specification and changes, runs a technical inspection, protects reservations in the protocol, inventories every physical and digital access item, transfers accounts, stabilizes the empty unit and follows every defect to evidenced closure.
The key appointment is one gate in a longer chain, not proof that every contractual, municipal or technical condition has been satisfied. This guide is for a foreign resident, an Israeli living abroad, an investor, a future oleh household or any owner unable to attend. If you are still comparing new projects in Israel, negotiate the remote process early rather than after a short delivery notice.
The practical answer: control authority, evidence and decisions
For every act, name the person who performs it, the person who approves it and the evidence that remains. The buyer’s Israeli lawyer reviews the contract, legal readiness, authority package, payment instructions and protocol wording. An independent engineer inspects and measures. A local representative controls attendance, documents, keys and the evidence package. A property manager stabilizes the empty unit and coordinates later access. The owner reserves commercial decisions and defines escalation limits.
One person may hold more than one role only where qualifications, authority, conflicts, insurance and reporting are clear. A live video does not make an agent an engineer. A lawyer is not expected to measure drainage falls. An engineer cannot sign for the owner without authority. A trusted relative should not waive a claim that was never delegated. A property manager should not release a final payment because a keypad works.

There is also no universal foreign-signature rule. The form and authentication of a power of attorney can depend on the principal, country of execution, intended act, document language, receiving institution and contract. An Israeli lawyer should draft the powers, determine execution and translation requirements and obtain the developer’s written acceptance. Do not assume that every case uses the same notary, consulate or apostille route.
Timeline from delivery notice to the 90-day review
Handover is a sequence of gates. The 7, 30 and 90-day points below are operational review habits, not statutory deadlines. Legal notices and binding dates follow the signed contract, applicable law and counsel’s directions.

Do not wait until the gate to learn that the engineer may not enter with instruments or that an original authorization was expected. Resolve those mechanics in writing and reconfirm shortly before the appointment.

Add a spending ceiling, time-zone availability, substitute and communication channel to every important role. “Represents the buyer” is not a sufficient scope. It does not reveal whether the person can sign, spend, receive a security instrument or grant access to a contractor.
A scoped power-of-attorney package
Counsel determines the valid form. The owner’s operational task is to list desired and prohibited acts. Possible desired powers include project entry, notice receipt, accompanying an engineer, photographing, receiving documents, entering reservations, signing only an approved form, collecting keys, applying to named services and communicating with management.
List separate prohibitions unless the owner gives a new instruction: waiving claims, approving substitutions, changing price, releasing an original guarantee, accepting unknown financial obligations, deleting a material defect, subdelegating, or commissioning work above an agreed ceiling. Store the original and sensitive identity records under restricted access. Do not distribute them in a broad messaging group.
Developer pre-approval and site entry
A formally valid document is useless if project security has never received it. Send representative identity details, the accepted authority package, engineer details and proposed equipment in advance. Ask for written confirmation that each named person may enter and perform the intended task.
Confirm building, entrance, floor, apartment, parking and storage references. Ask how many people may attend, time allocated, availability of water and electricity, lift operation, parking, protective equipment, video permission and access for a pre-handover survey. A two-stage method is valuable where contract and developer allow it, but it is not an unconditional entitlement created by this article.
Send a one-page attendance sheet shortly before the appointment, with names, telephone numbers, arrival window and role. Ask for reconfirmation. On arrival, record the building, floor and unit identity before filming details so the evidence cannot be confused with another apartment.
Build the handover data room
The folder should be controlled, backed up and owned by the buyer. A single copy inside a service provider’s account creates dependency. Name every file with apartment, document type, date and revision. Preserve the controlling Hebrew original and keep any translated summary as a linked, separate file.

Use role-based access. The engineer does not need bank records. A curtain installer does not need the power of attorney. Remove access when a provider finishes.
Establish the binding baseline

Separate an installed product from a preparation, allowance, option or marketing image. Give each item a stable ID used in the engineer report, video and protocol.

Where a model is binding, capture its label. Where a dimension is binding, define the measurement method. Where performance is promised, show context and test. Product codes and approved samples are more reliable than translated colour names.
Two-stage inspection where permitted
The first stage is a technical survey close enough to completion for the engineer to inspect surfaces, systems, dimensions and operation. Its advantage is time for correction. The second stage is the possession appointment, when the team reconciles repairs, documents, meter readings and access.
If only one visit is permitted, prioritize a qualified professional, adequate time and a prepared baseline. Do not spend the visit searching emails. Load plans in advance. Confirm that water and power are available for the tests the engineer intends. If a system cannot be tested, record “not tested” with the reason, not “satisfactory.”
The independent technical report is not the developer’s handover protocol. One is expert evidence for the buyer. The other records the possession event. Connect them by defect IDs and express references, without assuming one automatically becomes an attachment to the other.
Evidence-grade continuous video
Useful video answers five questions: which unit, when, who recorded it, where the detail is and what operation occurred. Begin at an agreed identity point. Film the floor, apartment number and route without a cut. Complete one orientation pass, then a detailed room-by-room pass.
For each issue, capture wide context, medium location and close detail. Say the room and item ID aloud. When the engineer uses a ruler, level or instrument, show both the measurement location and display. Video supports an audit trail, but does not reveal hidden construction or replace calibrated instruments and professional judgment.
Keep original files, not only a compressed messaging copy. A name such as A1203-BATH2-D014-20260807-01 connects unit, room, item, date and sequence. Retain camera operator and time. A file hash may support integrity where the team can manage it, but it is not presented here as a universal legal requirement.

Defect and exception register
Assign one immutable ID per item. Separate observed fact, suspected cause and proposed remedy. “Water remained at reference point X after the engineer’s test” is an observation. “Waterproofing failure” may be a diagnosis requiring expertise. Do not invent a universal legal threshold for critical, major or minor.

Do not close an item from a different-angle “after” photograph. The person who defined the test should define closure. Inspect collateral damage caused by the repair.
Control the handover protocol signature
Request the developer’s form before the date and have counsel review it. The representative should not improvise legal reservations at the gate. Prepare a working qualification, method for referencing the engineer report and attachment list. During the appointment, write legibly and obtain a complete copy with all signatures and attachments the same day.
The Sale Law Commissioner’s April 2024 position addresses seller demands that buyers waive claims about nonconformity with the contract or specification where mandatory protection applies. That supports legal review of waiver wording. It does not mean every signed statement is harmless, nor that every clause automatically defeats rights. Treat the protocol as important evidence.
There is no universal rule that every defect justifies refusal of possession, and no rule that possession must be accepted in every condition. Severity, usability, safety, contract and law require engineer and lawyer input. Give the representative a stop-and-escalate instruction, not unlimited discretion.
Inventory all physical access
Do not write merely “keys received.” Give each item an ID, quantity, function, holder and revocation route. Count apartment keys, cylinders and sealed packs, mailbox and storage keys, parking remotes, pedestrian and vehicle tags, lift or floor access, bicycle and stroller rooms, amenity access and any additional entitlement.
Ask about a master-key system, contractor access and repair arrangements. Photograph each item beside its ID without exposing key cuts or access codes in a public folder. Record every transfer from representative to property manager with date and acknowledgement.

Transfer digital ownership and smart-home control
List intercom enrollment, smart lock, home automation, router, cameras, alarm, leak sensors, HVAC application, EV charging, parking and amenity booking. For each, record administrator account, recovery method, licence, subscription, SIM or cloud responsibility, warranty and support.
The owner needs administrator ownership, not only guest access. Replace default credentials, enable stronger authentication where supported, remove temporary contractor users and confirm that an old installer account cannot reach private cameras or microphones. Israel’s National Cyber Directorate recommends changing default passwords and applying available security controls to smart cameras and connected products.
Do not send all credentials in one unprotected file. Use a suitable password manager or controlled transfer method. Store recovery codes separately. Give the property manager only the permissions required and record revocation.
Meters, utilities, arnona and management
Photograph every meter with serial, reading, unit identifier and date. Distinguish a private meter, shared allocation and temporary construction supply. Record electricity, water, gas where present, hot-water or solar interface where relevant, charging submeter and management allocation.
For each account, name the applicant, required identity and property-link records, billing start, payment method and confirmation number. The Israel Electric Corporation, water corporations, municipalities and management companies do not necessarily use the same workflow. A Tel Aviv municipal example is not a national form. Verify the exact current procedure for the property.
Arnona is municipal tax associated with the registered holder under the municipality’s process. Do not assume ownership, possession, billing and tenant entry are the same date. Coordinate the notice through counsel or the property manager, retain the receipt and verify the first bill’s name and delivery address.

Payment, security, possession, insurance and risk
Before the appointment, counsel prepares a closing instruction sheet: completion evidence reviewed, contractual condition for final payment, treatment of any security or guarantee, authorized bank actor, insurance start and operational responsibility. There is no universal final-payment percentage or retention. The representative should not release funds or an original security merely because keys are visible. The guide also does not advise withholding money without legal grounds.
The 2021 regulations, within their subject and applicability, address proof of construction completion and utility connections, and state that possession is delivered with seller and buyer or their representatives together in the apartment unless their contract provides otherwise. A key transfer alone does not prove every occupancy, system or contract condition. Counsel checks the actual project records.
Speak with the insurer or broker before possession. Disclose that the new unit may remain vacant and that developer contractors will return. Request written confirmation of commencement, vacancy conditions, water damage, works and key custody. Do not assume the building’s policy covers the apartment interior or contents.
Stabilize an empty new apartment
The first-week objective is to prevent quiet damage. Identify and label the main water valve, local valves, electrical board and circuits, balcony drains, sanitary traps, windows, shutters, AC, leak sensors and alarm. Decide what remains on or off according to equipment instructions, site conditions and insurer directions. There is no universal rule to close all water or run AC continuously.
Preserve evidence before removing construction dust. Check that packaging does not cover a drain, no water is standing and traps are managed under appropriate advice to prevent odour. Do not run a new appliance for the first time without instructions and attendance. Label controls so a substitute representative can act.
Arrange documented visits after first substantial rain, severe heat, water restoration, contractor work and first meaningful use of showers, laundry and AC. Repeat the same reference photographs. A property manager should not close an engineering defect without the defined recheck.
Mamad and common-property interfaces

Apartment keys do not prove that lifts, parking, storage, lobby, gates, refuse route or promised amenities are fully operational. Building-wide systems belong in the common-property handover guide. 7, 30 and 90-day operational reviews
These are management checkpoints, not legal deadlines. Around day 7, confirm all account applications, stable vacant-unit condition, matching access inventory and sent defect notices. Around day 30, review corrections, the first bill, initial system use and moisture. Around day 90, recheck open items, supplier warranties and emerging patterns.
Add event-based reviews after first substantial rain, first hot period, full AC operation, shower and laundry cycles, EV charging where applicable and common-system interruption. Preserve before-and-after evidence.
Send formal developer notices through the channel counsel and contract identify, with delivery evidence. A service chat is useful operationally but may not be the formal channel. Retain case number, date, attachments and response. An urgent damage-control issue should not wait for a calendar checkpoint.
Furnishing, contractors and first tenant
Do not conceal floors, walls or wet zones before recording them. Take final site dimensions before fitted furniture, glass, curtains and appliances. Preserve contractor repair access. Define responsibility if a private installer damages a finish or the developer damages furniture during repair.
A controlled sequence closes defects that will be concealed, measures the finished apartment, installs reversible items, then undertakes approved permanent work. Photograph before and after each provider. Do not give a furnishing contractor permanent smart-home administrator rights.
Before a tenant enters, create a separate handover event: condition, readings, keys, equipment, instructions and photographs. A tenant signature does not prove developer defects were resolved. Maintain separate registers for developer defects, supplier damage and tenant condition.
Bilingual control and metric discipline
Give every room, document, drawing, defect, key and meter a stable ID. Use metric units. If an overseas supplier works in inches, show the conversion and tolerance and do not round without approval. Identify products by code and photograph rather than translated colour name. High-risk decisions receive a numbered written confirmation, not only a voice message.
Stop and escalation conditions
Stop any signature outside authority, release of an original security, payment without counsel’s instruction, defect deletion without reinspection, contractor entry without appropriate arrangements, administrator-password transfer in an open channel, or vacancy without an accountable visitor. A stop is not automatically a refusal of possession. It is a focused pause for the right decision-maker.
Missing readiness records go to counsel. Suspected technical or safety issues go to the engineer. Missing access goes to the developer with an inventory record. Failed account transfer goes to the exact provider under its current process. Active leakage requires damage reduction under professional and insurer direction while evidence is preserved.

Can I receive the keys without travelling to Israel?
It may be possible through an accepted representative, but the contract, applicable delivery rules, developer requirements and authority form must be checked. Israeli counsel defines authority and the developer should approve the person in advance. Key receipt still needs inspection, documents, readings, account actions and follow-up.
Can my lawyer also perform the snag inspection?
The lawyer controls contract, authority, payment and protocol language. A qualified engineer or inspector performs technical measurements and testing. One person may hold multiple roles only with the right competence, authority and conflict controls. Separating roles normally improves verification.
Does every overseas power of attorney need an apostille?
There is no single rule. Requirements depend on signer, country, act, language and receiving institution. Israeli counsel should draft the power, determine authentication and translation, and obtain developer acceptance before the appointment. Do not copy a route used by another buyer.
Is a live video call enough instead of an inspection?
No. Video gives orientation, supports owner decisions and preserves visible evidence, but cannot reveal concealed conditions or replace instruments and on-site judgment. Combine an independent professional, stable IDs, a continuous shot plan and original files.
Should the inspection occur before key handover?
A two-stage method is useful where the contract and developer allow it: a technical survey close to completion, then a possession-day recheck. It is not an automatic entitlement. If only one visit is available, prepare the baseline, secure enough time and prioritize the engineer.
Does signing the protocol waive all rights?
There is no universal answer. The protocol is important evidence and waiver wording deserves independent legal review. The 2024 Sale Law Commissioner position addresses waivers conflicting with mandatory protections, but buyers should not assume every statement is harmless. Preserve qualifications, the report and a complete copy.
Must the representative refuse possession if defects exist?
Not automatically. Severity, safe and practical use, contract and law must be assessed. The engineer records the technical condition and the lawyer advises on possession and wording. Give the representative a clear escalation instruction rather than a blanket accept-or-refuse rule.
When is the final payment due?
The signed contract and counsel’s closing instructions control the amount and timing after review of completion evidence and securities. There is no universal percentage. The representative should neither release funds because keys appear nor withhold payment without legal grounds.
What should be handed over with the keys?
Inventory apartment, mailbox, storage and parking access, remotes, cards, lift and amenity permissions, manuals, warranties, administrator accounts, recovery codes, readings, installation records and the open-defect register. Give every item an ID, quantity and custodian.
How are electricity, water and arnona transferred from abroad?
Assign an applicant for each body, photograph meter serial and reading, verify current identity and property-link requirements, submit through the official process and retain confirmation. Electricity, water corporation and municipality workflows differ. One city’s form is not a national rule.
How should a vacant new apartment be protected?
Preserve condition evidence, label valves and circuits, inspect windows, drains, traps, sensors and appliance state, coordinate insurance and schedule visits. Recheck after rain, heat, water restoration and contractor work. Water and climate settings should follow equipment, site and insurer directions.
When can furnishing or tenancy begin?
After surfaces and final dimensions are documented and defects that would be concealed are resolved or managed. Preserve repair routes, allocate responsibility for damage and record each contractor’s before-and-after condition. Create a separate tenant handover; it does not close developer defects.
